1. About Us

CarBasket Automobile Services India Private Limited, having its registered office in Bangalore within the limits of Bruhat Bengaluru Mahanagara Palike (BBMP), Karnataka (hereinafter referred to as “CarBasket”, “we”, “our”, or “us”), is a government-registered company (CIN, GST, MSME, Startup India).

The website carbasket.in operates as a pan-India aggregator and facilitator, connecting vehicle owners with authorised, registered, or state trade-licensed partners for vehicle scrapping, resale, second-hand spare parts, vehicle inspections, and third-party insurance.

1A. Eligibility

Use of the CarBasket platform is permitted only to individuals legally competent to contract under Indian law. By using the platform, the customer confirms they are at least 18 years of age.

2. Our Role

CarBasket does not directly scrap vehicles, deregister RCs, or issue insurance policies. We act solely as a facilitator and coordinator between vehicle owners and authorised partners. All services are executed by partners, who are solely responsible for regulatory and legal compliance.

3. Liability Disclaimer

CarBasket shall not be liable for actions or omissions of partners, including:

• Improper scrapping, dismantling, recycling, or environmental violations
• Non-compliance with state or central regulations
• Penalties, challans, fines, or legal consequences arising due to vehicle owner non-compliance

4. Vehicle Scrapping

• Vehicle owners remain solely responsible for RC deregistration at the respective RTO.
• CarBasket may assist by facilitating scrap certificates or supporting documents where permitted.
• Scrapping and dismantling are performed exclusively by authorised partners.

4A. Certificate of Destruction (CoD) & Certificate of Vehicle Scrapping (CVS)

CarBasket may issue a Certificate of Destruction (CoD) as a facilitation document after completion of pickup and dismantling via partners.

The Certificate of Vehicle Scrapping (CVS) is issued only by authorised or registered vehicle scrapping facilities. CarBasket does not independently issue CVS but may assist in obtaining it.

Timelines and documentation requirements vary by location, partner facility, and applicable laws. CarBasket does not guarantee acceptance of any certificate by authorities.

5. Services Beyond Scrapping

• Buying and selling of vehicles and spare parts are facilitated via partners
• Insurance products are provided by licensed third-party insurers
• Service execution responsibility rests solely with partners

6. Refunds, Payments & Cancellations

Refunds, cancellations, and disputes are governed by partner policies. Payments may be held in escrow and released upon verification or completion of services. CarBasket does not guarantee refunds.

6A. Vehicle Condition, Legal Status & Owner Responsibility

Vehicle owners confirm full disclosure of FIRs, police cases, challans, loans, hypothecation, blacklisting, or any legal issues.

CarBasket is responsible only for physical damage during transportation. Pre-existing legal or regulatory issues remain the owner’s responsibility.

6B. Ownership & Authority

Customers confirm they are the registered owner or have valid authorisation. CarBasket is not responsible for ownership disputes or forged documents.

6C. Price Discovery & Final Settlement

Prices are indicative and subject to inspection and verification. CarBasket reserves the right to revise or cancel transactions in case of discrepancies.

6D. Force Majeure

CarBasket shall not be liable for delays caused by events beyond reasonable control, including government orders, RTO downtime, strikes, system failures, or regulatory changes.

6E. Indemnity

Customers agree to indemnify and hold harmless CarBasket from claims arising due to false information, ownership disputes, or legal violations by the customer.

6F. Limitation of Liability

CarBasket’s total liability shall not exceed the amount paid for the specific service giving rise to the claim.

6G. Electronic Communication

Customers consent to receive service-related communications via phone calls, SMS, WhatsApp, email, and electronic notifications.

6H. Right to Refuse or Terminate Service

CarBasket reserves the right to refuse or terminate services if incorrect information is provided, documents are incomplete, or legal or compliance risks are identified.

6I. User Conduct

Users must not engage in fraudulent, illegal, or abusive activities. Violations may result in suspension or legal action.

7. No Warranty

CarBasket makes no warranties regarding prices, timelines, deregistration completion, or service outcomes.

8. Intellectual Property

All content, logos, graphics, and data on carbasket.in are owned by CarBasket and may not be reproduced without written consent.

9. Governing Law & Jurisdiction

These Terms are governed by Indian laws including the Motor Vehicles Act, Consumer Protection Act, Vehicle Scrappage Policy, and IT Act.

Jurisdiction shall vest exclusively with the competent courts having territorial jurisdiction within the limits of Bruhat Bengaluru Mahanagara Palike (BBMP), Bangalore, Karnataka.

10. Changes to Terms

CarBasket reserves the right to modify these Terms at any time. Continued use of the platform constitutes acceptance of updated terms.

10A. Severability & Waiver

If any provision is held invalid, the remaining provisions shall remain in full force. Failure to enforce any right shall not constitute a waiver.

10B. Privacy & Data Protection

Customer data is processed in compliance with Indian laws and shared only with partners for service facilitation.

10C. Taxes

All prices and payments may be subject to applicable GST, TCS, or other taxes unless stated otherwise.

Final Disclaimer

CarBasket acts solely as a facilitator. Vehicle owners remain legally responsible for their vehicles until deregistration is completed by the concerned authority.
